We’re finally seeing felony conspiracy charges coming out of the U.S. Capitol attack. This has led some of you to ask if I think Donald Trump will be criminally charged as part of that conspiracy. It’s too early to tell; such charges come down to specific evidence that would sway a jury to convict, not whether someone is “obviously” guilty in the court of public opinion sense.

But I do know that if Trump is charged on a federal level, it’ll simply be a matter of piling on. New York has had a widely documented grand jury targeting Trump for indictment on financial crimes for more than a year now. Ever since he lost the election, we’ve seen news every few days that puts him closer to indictment.

While there’s no way to predict specifically when the Manhattan District Attorney will choose to have the New York grand jury bring an initial indictment against Trump, all publicly available evidence points to it definitely happening, and happening soon. And when it comes to the black and white nature of financial crimes, conviction is nearly automatic. So yes, Trump is going to prison in New York, whether the Feds also criminally charge him or not.
