U.S. Appeals Court rules against Donald Trump, huge victory for January 6th Committee

When a federal judge ruled that the National Archives had to turn over Donald Trump’s records to the January 6th Committee, and Trump filed a last minute appeal, some observers worried that Trump would succeed in dragging things out and “running out the clock.” But in reality the appeals court set a very swift timetable, and the judges’ statements strongly suggested that they would rule against him. We predicted that the appeals court would rule sometime this month, and that Trump would lose.

Sure enough, the appeals court just ruled against Trump, upholding the lower court ruling that the National Archives must turn over Trump’s records. The appeals court has stated that Trump can appeal to the Supreme Court if he wants. But this is the kind of clear-cut case that the Supreme Court is unlikely to even want to touch, let alone side with Trump on. So even if Trump does appeal to the Supreme Court, we expect that to get shut down rather quickly.

The bottom line is that Donald Trump just lost big time, and it’s a huge victory for the January 6th Committee. The committee now simply has to wait for the Supreme Court to affirm that it wants no part of this mess, and then the committee will immediately get Trump’s records from the National Archives. So much for Trump magically running out the clock.
