This is why you can still expect Roger Stone to end up criminally indicted
Newly revealed footage of Roger Stone shows him actively trying to overthrow the 2020 election on behalf of Donald Trump. While this footage is “new” for the media and the public, I’m guessing it’s very much not new to DOJ Special Counsel Jack Smith. He’s spent all this time turning over every rock possible, and it’s likely that the person who took this footage gave it to prosecutors long before giving it to the media. Even if Smith didn’t already have it, he does now, by default.
Of course this footage is far from the only evidence against Roger Stone. There has been previous footage of him. There is also the cooperation deal that his January 6th chauffeur (a member of the Oath Keepers) long ago cut with the DOJ. There is the cooperation deal that someone who was present in the Willard Hotel “command center” cut with the DOJ in June. There’s plenty of evidence pointing to Stone’s guilt in relation to January 6th.
This is why I still expect that Jack Smith’s ongoing investigation is going to end up indicting people like Roger Stone. Everything about Smith’s actions thus far suggests he’ll ultimately indict everyone he reasonably thinks he can convict. The only way someone like Stone won’t be indicted is if Smith concludes that the evidence against him is ultimately insufficient to get a conviction. And that’s always possible. But don’t assume that anyone who hasn’t been indicted yet has “gotten away with it all.” There are very likely more indictments still to come.
