There’s “no question” that Jack Smith will also criminally indict Donald Trump for January 6th
When I first saw the text of Jack Smith’s classified documents criminal indictment against Donald Trump, my first thought was “this is just the beginning.” It was a comprehensive and aggressive enough indictment that it made clear that Smith is trying to knock Trump out. And yet the indictment was so limited in focus, it led me to believe that there had to be more indictments coming against Trump. After all, this indictment didn’t even appear to touch on the testimony that Mark Meadows reportedly gave about Trump stealing the documents to begin with.
Even as we wait to see if more charges against Trump do emerge from the classified documents probe, it now seems plainly clear that Jack Smith will end up criminally indicting Donald Trump relation to January 6th. And I’m not the only one who sees it that way.
Former federal prosecutor Andrew Weissman stated on MSNBC on Tuesday afternoon that after what he’s seen so far, there’s “no question that Jack Smith will also criminally indict Donald Trump for January 6th. His reasoning is similar to mine: if Smith is going this hard at Trump for his classified document crimes, of course he’ll go just as hard at Trump for his January 6th crimes (and other crimes).
Keep in mind that Smith has already moved his January 6th case against Trump most of the way down the road, even going so far as having Mike Pence testify against Trump to the grand jury. It’s also notable that the January 6th indictment against Trump will very likely happen in Washington DC, setting up a whole separate federal trial from the one that Trump is facing in Florida.
