Supreme Court meltdown
The Supreme Court has devolved into one long and agonizingly sophomoric soap opera. The purity — and sanctity -– of the Court is gone. We have a court with a few good Justices and many bad actors in its place. Any day now, we can expect a decision on Roe. I want to point you toward an article about this case.
This article from Slate talks about what would happen if the three liberal Justices and Justice John Roberts were to recuse themselves from the case. If they did that, the Supreme Court would be denied a quorum. Under federal law, they must have said quorum, which would need at least six Justices to establish the quorum.
Were four Justices to recuse — there would be no way of going forward on the case. There is also no specific rule needed to recuse. So, therefore, were the four Justices to do that, the rest of the Supreme Court would not be able to move forward for now.
I like this idea but doubt all four Justices would do it. But that is not the only thing making news regarding the Court. The Court is going to soon issue a ruling in a critical Second Amendment case involving the state of New York’s concealed carry laws.
This decision will impact the carrying of guns in public, and in the wake of all the recent shootings., the Court risks looking even more out of step with the mainstream than they already do.
And let’s not forget the game of clue going on. What do I mean by that? I speak of the investigation into the leak, which has not gotten very far at the time of this writing. According to multiple reports, law clerks are being asked for phone records, and some of these clerks are thinking of hiring outside counsel due to potential privacy violations.
So as you can see, the Supreme Court is drowning in controversy. Every move is being scrutinized as they make bad decision after bad decision. If we win the midterms, perhaps we can begin to mend the crack in the highest Court in the land.
