Michael Flynn appears to give away that Jack Smith’s grand jury is still actively pursuing indictments

When Michael Flynn stood on a stage next to Peter Navarro over the weekend and begged the audience to put “pennies” in a jar, most observers on social media were quick to lament about how Flynn is still out there grifting. But here’s the thing: Flynn may have just given away something big.

Flynn stated that he and Navarro needed the money because they just received another “batch of subpoenas” from Jack Smith. By rule, a federal grand jury can only remain active if it’s for the purpose of bringing additional potential criminal charges and indictments – not simply to further investigate existing charges for the purpose of amassing trial evidence.

So if Flynn is telling the truth, then it means Jack Smith’s grand jury is still active, and that Smith is still aiming to bring more criminal charges. Specifically, Smith is looking to bring charges that are related to evidence that the likes of Michael Flynn have on them. This would suggest that either Flynn, or someone around him, is on track for potential indictment.

Of course it’s possible that Michael Flynn is lying about this. But in such case he’d be attempting to raise money by falsely claiming he’d been subpoenaed by a grand jury, which would be fraud. So Flynn may be in trouble here either way. Just because he’s evaded indictment thus far, it doesn’t mean it’s not coming. Flynn himself just told us that Jack Smith’s grand jury is still actively investigating things that relate to Flynn. Tick tock.
