Looks like Bill Barr will be a star witness in Donald Trump’s criminal trial

Donald Trump’s former Attorney General Bill Barr belongs in prison himself for obstruction of justice. But while it doesn’t look like that’s going to happen, it turns out Barr is set to be a star witness for the prosecution in a trial that’s set to send Trump to prison.

Fulton County District Attorney Fani Willis has included Bill Barr on her list of trial witnesses, according to the Atlanta Journal-Constitution. As a reminder, when someone witnesses a crime but does not participate in it, they are required by law to testify about it. You can only plead the fifth if you participated in the crime, or you otherwise reasonably believe you could incriminate yourself, or that your testimony could be used to prosecute you. Barr was on his way out the door and was not a co-conspirator by the time Trump tried overthrowing the 2020 election, so by law he has to testify against Trump.

Another interesting inclusion on Fani Willis’ witness list is Steve Bannon. He’s already been convicted on the misdemeanor charge of contempt of Congress and is appealing his small prison sentence in that case. He’s also awaiting trial on far more serious fraud charges in New York, and once he’s convicted on those, it’s highly unlikely he’ll be able to avoid prison while appealing. But because Bannon isn’t considered a co-conspirator in Trump’s Fulton County antics, Bannon will be required to testify against Trump. Failure to do so would result in Bannon being locked up for contempt of court. So either way we win.
