John Eastman court ruling means the odds of the DOJ prosecuting Donald Trump just went up

Federal Judge just ruled it’s “likely” Donald Trump and John Eastman conspired to obstruct Congress. That would be a felony. Judges don’t get to tell the DOJ who to prosecute. But this kind of thing carries significant informal weight. Odds of DOJ indicting Trump just went up.

Additionally, because the January 6th Committee will now get Eastman’s emails, it’ll get to prove to the public that Trump directly conspired to overthrow the election. Which will make it a lot harder for the DOJ not to prosecute Trump.

The DOJ was always going to want a cooperating witness against Trump before deciding to prosecute him. So now that the Eastman emails are going to become public record, let’s watch to see if Eastman – or anyone else incriminated in those emails – decides to cut a deal with the DOJ.
