Jack Smith makes court filing citing Donald Trump’s unhinged Truth Social post

So that didn’t take long. This afternoon Donald Trump posted “IF YOU GO AFTER ME, I’M COMING AFTER YOU” on Truth Social. We pointed out that while this post alone would be unlikely to prompt the judge to throw Trump (or any defendant) in jail while awaiting trial, there was no doubt that Jack Smith was going to put Trump’s post in front of the judge one way or the other.

Sure enough, the DOJ has already made a court filing this evening, citing Trump’s post and seeking a protective order against him. This isn’t the same as a gag order. But a protective order is a first step. Then if Trump keeps making posts like this the DOJ will be able to file for a gag order, and then after that, revocation of bail.

The courts tend to tack on these kinds of restrictions and consequences incrementally, in steps, in escalating proportion to the defendant’s behavior. The consequences don’t come all at once. But they do come. Trump will not “get away” with making posts like this. He’s either delusional to think that he can, or he’s trying to get the courts to finish him off.
