Jack Smith just handed out immunity to two small fish in order to nail Donald Trump for trying to overthrow the election
Jack Smith recently had two of the “fake electors” testify to a general grand jury in the criminal probe targeting Donald Trump and others for 2020 election related crimes. This led to the question of how Smith had pulled it off. After all, you can’t be compelled to testify against yourself – and Smith wouldn’t have wasted time putting these two witnesses on the stand if they were just going to plead the Fifth.
Now it turns out Jack Smith gave these two electors limited immunity, per CNN. This is notable for a few reasons. These were apparently straggler witnesses who had been given a testimony deadline of the end of this month, but had been threatening to invoke the 5th. This suggests that Smith really wanted their testimony in order to nail bigger fish like Trump. It also suggests that Smith intends to have all testimony in this case wrapped up by the end of this month – which means indictments should come soon after.
It’s worth underscoring the fact that prosecutors don’t hand out immunity to little fish unless they plan to use it to indict big fish. This immunity news makes clear that Jack Smith isn’t planning to simply indict the little fish and call it a day. He’s aiming for the people at the very top (Trump and his pals), and he intends to take them down by whatever means necessary. And now we know we can indeed look for election related indictments soon – perhaps hypothetically as soon as next week.
