People often say things they don’t really mean or at least don’t mean literally. Donald Trump says what he means and doesn’t care what anyone thinks about it. That arrogance is about to come back and bite him in the ass. Various media outlets reported that the Special Counsel’s recent filing indicates that they have additional evidence against Donald Trump, and that evidence is his words. The Special Counsel’s filing indicates that they plan to use his history of calling elections “fraudulent” when they don’t turn out the way he wanted, including public statements over the last decade. It specifically references Trump’s tweet from November 2012, claiming that voting machines had switched votes from Romney to Obama. When he ran, he repeatedly claimed widespread voter fraud existed. From the Special Counsel’s perspective, Trump was laying the groundwork to justify his criminal behavior after the 2020 election. Further, the Special Counsel points to Trump’s repeated refusals to ensure a peaceful transition of power as his intent to remain in office no matter the cost, including violence.

This filing further includes texts from a campaign employee to a campaign attorney with a plan to obstruct the vote count in Detroit by creating a riot when the votes began trending toward President Biden. Around the time of these messages, it was observed that “a large number of untrained individuals flooded the TCF Center and began making illegitimate and aggressive challenges to the vote count.” Make no mistake: this is the action of an in-depth conspiracy at work. The depths of Trump’s plans seemed to know no bounds. To have people standing by, ready to interrupt the vote count shows just how far these people were willing to go. It also proves that Donald Trump knew damned well that he had lost the election. Neither this filing nor the evidence it contains bode well for Donald Trump. Indeed, when you read all of this together, you get a real picture of what the Special Counsel intends to and will likely prove in his case. He also plans to use Trump’s affinity for the January 6 insurrectionists against him in this trial.

The Special Counsel has loaded his arsenal against Trump. It’s time to stop wondering whether Trump will ever have to pay for the crimes he committed. This filing lays out a plan that most of us had never pieced together, beginning as far back as 2012. Trump had planned to dispute the results in the 2016 race had Hillary Clinton won. He had already set it up. He refused to commit to accepting results of that race, just as he refused to commit to a peaceful transfer of power in 2020. He was just waiting for the right opportunity to roll out his plans.

Ultimately, whether the Special Counsel will be able to use this evidence will be up to Judge Tanya Chutkan. It’s not evidence per se of the instant conspiracy, but it establishes a pattern and practice of behavior by Trump, and that pattern and practice points right to the current conspiracy.
