Here comes Donald Trump’s criminal trial sentencing

New York Judge Juan Merchan came off as tough but fair throughout Donald Trump’s criminal trial and conviction. But then, in one of the most disappointingly inappropriate decisions in the history of the United States judicial system, Merchan decided to postpone Trump’s sentencing until after the election.

I know some of you have tended to defend Merchan over this. But in reality, by postponing the sentencing, Merchan handed Trump the election. No excuses; Merchan simply blew it. We’ll never know for sure why he did it, but Merchan is the reason Trump is heading back into office. Even if Merchan thought he was doing the right thing in the wake of the Supreme Court ruling on immunity, it was still 100% the wrong call. (Please don’t email me if you disagree with this, just accept that this is my position and it won’t change, regardless of your position on the matter).

In any case, now that Merchan has handed the presidency to Donald Trump, Merchan has decided to hold a sentencing hearing after all – next week. It’s already being made clear that Merchan isn’t even going to bother to give Trump so much as a symbolic and unenforceable prison sentence. Instead Merchan is seemingly going to simply lecture Trump about how he’s a criminal, and then give him some kind of “sentence” that isn’t prison. Then Trump will be able to brag about how he can’t really be a criminal because he wasn’t even given a prison sentence. Then Trump will take office and commit more crimes.

So yeah, I’m not excited about Trump’s sentencing hearing. Merchan may argue that he didn’t want to tip the scales of the election by sentencing Trump beforehand. But by taking Trump’s sentencing off the table, Merchan allowed Trump to spend the election credibly arguing to voters that he wasn’t actually a criminal – even though it wasn’t true.

Remember, even with all the other fiascos that happened (Supreme Court immunity ruling, case randomly assigned to Aileen Cannon, Fani Willis affair, and so on), Donald Trump was still on his way to a New York prison before Merchan delayed his sentencing hearing. Trump really was going to prison. And now, because the judicial system continues to fail us in every way that it can think of, Trump is going to the Oval Office.
