Has Jack Smith already indicted Donald Trump under seal for January 6th?

When the news broke that Jack Smith’s Trump 1/6 grand jury didn’t meet today, even though it typically meets on Tuesdays, I spelled out a few possible reasons why. One was that the grand jury simply didn’t meet today because there are no more witnesses left to hear from for these particular charges, and that Smith has for whatever reason decided to wait until Thursday to indict. Another possible scenario was that Smith has already had the grand jury indict Trump under seal, and is just waiting to unseal it.

I’m leaning toward the former, simply because the most straightforward answer is usually the correct one. But now one legal expert is pointing out how realistic it is that the grand jury may have indeed already indicted Trump under seal. So why would Smith do such a thing? Perhaps he’s planning to unseal the charges alongside Fani Willis’ related charges next week, or something along those lines.

I can’t stress enough that we’re all just making our best educated guesses when it comes to grand jury timing. If I were forced to put money on it, I’d say this Thursday is probably still the most likely scenario. But it is noteworthy that we’re so close to the finish line, at least one legal expert is pointing out that we may have already crossed it without knowing it.
