When Fulton County District Attorney Fani Willis cut non-prison plea deals with the likes of Sidney Powell, Kenneth Chesebro, and Jenna Ellis, it set off a wave of fear and loathing on the part of social media observers who aren’t familiar with how these kinds of cases work. If the smaller fish were getting off the RICO hook without prison, did that mean everyone in the case would get to go home?

No, not at all. The entire reason a prosecutor like Willis cuts lenient deals with smaller fish like Powell and Ellis is so that their resulting cooperation will help make sure the biggest fish go to prison.

Last month it was reported that Willis had decided not to offer plea deals to Donald Trump, Mark Meadows, or Rudy Giuliani. At the time I pointed out that this meant that if they’re convicted at trial – which is extremely likely given the evidence and cooperators against them – they’re going to prison.
