SDNY targets criminal charges against “Executive 2” – and it looks like it’s one of Donald Trump’s kids
The fallout continues from today’s sentencing of Michael Cohen, and the corresponding non-prosecution agreements that the SDNY has given to the National Enquirer’s David Pecker and to Trump Organization CFO Allen Weisselberg. The charges against Cohen reveal that he was criminally conspiring with two Trump Organization executives to make illegal hush money payoffs – and one of them appears to be one of Donald Trump’s kids.
According to SDNY, Michael Cohen was plotting with “Executive 1” – who is all but certainly Weisselberg – and an unidentified “Executive 2.” The thing is, there are very few officials in the Trump Organization who could have signed off on something like this. In fact the only plausible possibilities are three people named Trump. Politico is making the argument that it’s most likely Donald Trump Jr. There is reason to suspect it might be Eric Trump, as it was reported months ago that Donald Trump ordered Eric and Michael Cohen to silence Stormy Daniels. There is also an argument to be made that it’s Ivanka, based on her overall role in the Trump Organization at the time.
Here’s the key: the SDNY knows who it is, and likely has the person nailed. Allen Weisselberg is definitely in position to testify first hand about this person’s crimes, and Cohen and Pecker may have direct knowledge of the person’s crimes as well. Further, the charges against Cohen allege that Donald Trump criminally conspired with Executive 2.
So not only does it appear that SDNY is on the verge of indicting and arresting one of Donald Trump’s kids, it also appears that doing so will officially make Donald Trump an unindicted co-conspirator in a felony. He already fit this description by default, based on previous filings. But this would make it official.
That would make it very difficult for Donald Trump to pull off pardoning whichever of his kids is about to get popped, as there are numerous legal experts who believe that the courts would strike down an attempted pardon of an alleged co-conspirator. In addition, while the SDNY charges are on the federal level, it’s nearly a given that the Attorney General of New York has state level charges in place as a backup, in case Trump tries a pardon.
In other words, it looks like we’re on the verge of one of Donald Trump’s kids being indicted and arrested, and Trump not being able to do anything at all about it. This would further pin Trump down, leaving him with no cards left to play beyond offering his resignation in exchange for partial criminal leniency for him and his family.
