Either you trust Jack Smith or you don’t
When Special Counsel Jack Smith decided on Monday to ask the U.S. Supreme Court to quickly rule against Donald Trump’s claim of “presidential immunity,” it’s important to keep in mind that Smith didn’t have to make this move. He was already winning. The judge in the case, Tanya Chutkan, clearly intends to make sure the trial starts on time. And the U.S. Court of Appeals stated in a ruling just days ago that the trial will take place long before the 2024 election.
Smith didn’t make this filing with the Supreme Court out of any necessity. The Trump trial was already 100% on track to start on time. But Smith saw an opportunity. When Trump started running his mouth about how Chutkan supposedly had no authority over the case while Trump’s “presidential immunity” appeal played out, it opened the door for Smith to be able to convince the Supreme Court to jump in now and shoot it all down.
Jack Smith has seen that the Supreme Court has been consistently unwilling to stick its neck out for Trump on these matters, because it’s busy with its own separate corrupt agenda. Smith knows that the Supreme Court will once again decline to help Trump in any way. Smith understands that he can get the Supreme Court to shut down Trump’s appeal-based delay tactics before Trump can even get around to employing them, making it that much harder for Trump to push his trial back by even a single day.
Legal experts who know what they’re talking about are praising Jack Smith for this savvy and essentially guaranteed-to-succeed move. But doomsday hysteria types on social media are busy doing what they always do, which is to spin up worst case scenarios and then fret about them as loudly as possible, while pretending that this behavior makes them “vigilant.”
Meanwhile back in the real world, there’s nothing to sit around and fret about when it comes to this Jack Smith filing. The Supreme Court will either quickly rule in Smith’s favor, or quickly decline to take up the case (which would hand final say to the U.S. Court of Appeals, which has already clearly stated that Trump’s trial will take place on time).
The exact timeframe for the Supreme Court ruling doesn’t matter, because the case isn’t magically paused in the meantime. What matters is that Donald Trump opened his stupid mouth and handed Jack Smith an opportunity, and Jack Smith is seizing that opportunity in a way that will hand him a near automatic win.
Here’s the thing to remember: Jack Smith chose to make this filing. He didn’t have to do it. Again, he was already winning, and the trial was already on track to start on time. To make the argument that this Supreme Court is going to play out poorly for Jack Smith, is to make the argument that Jack Smith is a fool who doesn’t know what he’s doing. Unless you believe that Smith is indeed an idiot, there’s no reason to expect that this filing will somehow magically work out in Trump’s favor. Either you trust Jack Smith or you don’t. And everything he’s done thus far says we should indeed trust him.
