“I fear … that the administration is acting with a distinction without a difference.” This is not the kind of thing you ever want to read when a judge makes their decision – particularly when your administration has already had them rule against you once.

This is what happened with Donald Trump’s administration when the inevitable happened – a massive lawsuit filed against him by attorneys general in a number of blue states that forced him to unfreeze federal funding. The White House did concede, but rather than do it quietly, Press Secretary Karoline Leavitt made a statement that largely confused the media and government officials into thinking that the freeze on federal funding was still in effect.

This is why U.S. District Judge John McConnell felt it necessary to rule immediately against the Trump administration – blocking not just the freeze but the order as well. Staying quiet probably could have helped the administration get some distance from the order, but Trump’s own need to appear powerful – as well as playing up their supposed strength in the eyes of the media took precedent here – and only made them look even more incompetent – shortly before the administration may be dealing with a whole other potential scandal arising out of their own incompetence. This is yet another reminder that pushing back however you can against this administration is a good idea – and it definitely won’t be the last.
