Donald Trump has used his infamous Twitter account to publicly and viciously attack respected members of his own party, various world leaders, and even popular athletes. Yet for the first months of his Stormy Daniels scandal, he was afraid to attack her or even mention her name. Then he finally let loose with one accusatory tweet about her. Now that’s blown up in his face.

Stormy Daniels alleged that an unknown man approached her and threatened her with physical harm if she told anyone about her affair with Donald Trump. Daniels and her attorney Michael Avenatti released a police sketch of the man in question. This led Trump to finally lash out at Daniels on April 18th, tweeting “A sketch years later about a nonexistent man. A total con job, playing the Fake News Media for Fools (but they know it)!” Trump has since gone quiet about Daniels, perhaps realizing he shouldn’t have gone there.

Since that time, a lawsuit has continued to play out between Daniels and Trump’s fixer Michael Cohen, who handled the original negotiations for Daniels’ silence. Cohen recently convinced the judge to put the proceedings on hold for ninety days, under the expectation that Cohen will be indicted on criminal charges within that timeframe. So now Daniels is filing a lawsuit against Trump over his tweet, according to her attorney Avenatti.

Right now you’re probably wondering about the legal precedent which suggests an individual can’t sue a sitting president for actions he’s taken while in office, and that’s a good point. But the precedent is based on only a small number of cases, and Stormy Daniels can make the argument that Donald Trump’s tweet was a continuation of his actions toward her which began before he took office. Even if the suit is ultimately thrown out, the discovery process could serve to further expose the illegal activities of Trump and Cohen, which was the point of the original suit against Cohen.
