The Supreme Court may have kept Jack Smith from putting Donald Trump on trial before the election, but Jack Smith is clearly still on track to put Trump on trial when all is said and done. Smith obtained permission from Judge Tanya Chutkan to publicly release a redacted new filing spelling out Trump’s guilt, including what Smith said was new evidence. That filing went public today, and it makes clear that Trump really is going down.

The new filing reveals in detail the pattern of crimes that Trump committed in the name of trying to overthrow the 2020 election. It also reveals Trump’s guilty intent in various ways. At one point Trump was warned that Vice President Mike Pence’s safety was in danger, and Trump said he didn’t care. At another point a co-conspirator working with Trump said “Make them riot” in response to the January 6th crowd.

This filing is more than enough to get a criminal conviction against Donald Trump. Just as importantly, it makes clear that Trump was not acting in an official capacity when he undertook many of these actions – which means the charges now fall safely within the Supreme Court’s new limitations. In short, Jack Smith has Trump nailed to the wall. All we have to do is defeat Trump in this election and Trump is going to prison.
