The prosecution in Donald Trump’s criminal trial rested its case today, after a powerhouse display of key witnesses who served to corroborate each other’s testimony about Trump’s guilt. Then it was the defense’s turn to take over the trial, and the defense promptly made two moves that revealed its surrendering entirely.

First, the defense put Robert Costello on the witness stand, in testimony that went so poorly that the judge had to instruct Costello to stop hamming it up so badly. This testimony can’t possibly help Trump, and only seems designed to keep him happy.

Second, at the end of the day, the defense moved for a dismissal on the grounds that the prosecution failed to make a case. The move made legal sense on paper. But as a practical matter it merely prompted the judge to point out that the prosecution did indeed make a legitimate case. If anything it served as a reminder that the defense is a million miles away from having anything going for it in this trial.

So it’s fair to say that, in terms of trying to win this trial, Trump’s legal team surrendered today. The only faint hope Trump has left is some kind of jury fluke, which is a really weak thing to pin your hopes on. That’s like hoping to win the lottery. And it’s all Trump has left before becoming a convicted felon.
