Jack Smith drops the hammer on Judge Aileen Cannon
If you’ve been wondering why Special Counsel Jack Smith hasn’t simply gotten rogue Judge Aileen Cannon thrown off the Trump classified documents case, that’s because it’s not that simple. It takes a lot to convince the Appeals Court to intervene and take over. But it appears Smith now has enough in hand to swing for the fences.
Smith’s new court filing tonight accuses Cannon of getting things fundamentally wrong, and threatens to seek mandamus against the judge. This would essentially mean asking the 11th Circuit Court of Appeals to rule that Cannon is, in layman’s terms, out of her mind.
Will this result in the 11th Circuit stepping in and forcing Cannon to start making correct rulings? Will it result in the 11th Circuit taking the case away from her entirely? We’ll see. But Jack Smith has clearly been building up to this point for awhile, and now he appears to be going for it.
