Jack Smith is having a great day
Sidney Powell isn’t exactly known for her logical or pragmatic or even rational behavior. But even she can apparently see that Donald Trump is going to prison, and that everyone who doesn’t flip on him is going with him. Accordingly she cut a deal today with Fulton County DA Fani Willis to plead guilty and testify against everyone. But that’s only the half of it.
If you’re being prosecuted for the same criminal plot by two different prosecutors, you’d never cut a cooperation deal with just one of them. It wouldn’t work. If you plead guilty in one case, the Fifth Amendment goes out the window, and you then have to testify against your co-conspirators. But your testimony could be used against you by the other prosecutor. Powell might be loony enough to get herself into this kind of situation, but Fani Willis isn’t.
For Willis to have given Powell such a lenient deal (six years of probation, no prison time), Willis must be confident that Powell is going to a very valuable witness. This means that Willis has undoubtedly already explained to Powell that as part of this deal, she pretty much has to cut a deal with Jack Smith as well. Otherwise Willis wouldn’t be bothering to hitch herself to Powell like this.
In other words, Sidney Powell has either already cut a deal with Jack Smith or she’s about to go cut one. Otherwise Fani Willis wouldn’t be on board with this. And while Jack Smith doesn’t need Powell’s help to convict Trump, it always helps to pile on with even more cooperating witnesses. So yeah, Jack Smith is having a great day.
