Donald Trump desperately wants the focus to be on his imaginary 2024 presidential campaign, and not on the very real felony charges and criminal trials that now define his life. The problem for Trump is that he just keeps reminding everyone he’s under criminal indictment, and that he’s about to be indicted again.

Trump just can’t stop talking about how it should be President Joe Biden who’s criminally indicted, and not him. Unfortunately for Trump, making up laugh out loud fairy tales about your opponent’s imaginary crimes is not an effective tool for getting your opponent indicted. It is, however, a great way to make a Freudian slip.

On Saturday, Trump went on a social media bender about how Joe Biden should be charged under the “Insurrection Act” for supposedly stealing classified documents. Wait a minute, what? That’s likely falsely accusing someone of robbing a bank and then demanding they be criminally charged for dealing drugs. It’s completely incoherent. But it does give away that Trump has the “Insurrection Act” on his brain.

The Insurrection Act isn’t actually a law that you violate. It’s an executive power. But it sure does feel like Trump has been notified that he’s being indicted for insurrection-related crimes, and given that he’s already been indicted under the Espionage Act, he may have mistakenly presumed that he’s now being indicted under the “Insurrection Act.”

In any case, after everyone made a big deal out of it, Trump (or whoever has control of his Truth Social account) deleted the reference to the “Insurrection Act” and tried again, this time calling it the “Espionage Act.” Of course such a deletion only serves to raise more questions about why Trump and/or his people were so quick to try to remove his mention of the Insurrection Act.

We’ll find out soon enough. There was already every reason to expect that Jack Smith will likely indict Donald Trump on January 6th related charges within the next two weeks, before Fulton County DA Fani Willis’ indictment window begins at the end of July. And now Trump is acting like he’s already been informed that Jack Smith is indicting him on some kind of insurrection charges. If so, it won’t remain secret for long.
