Supreme Court nominee Brett Kavanaugh’s history with alcohol is relevant to his conformation process for two reasons. First, he stands accused of having drunkenly sexually assaulted several women in his youth, and these claims gain additional credibility due to the widespread claims that he was a heavy and belligerent drinker during this timeframe. Second, he appears to have lied under oath about his drinking history, which is a felony.

During his confirmation hearings, Brett Kavanaugh admitted that sometimes he drank too much beer, but he insisted that he was not an out of control drinker. But back in college, Kavanaugh and his friends rented a beachfront property. Kavanaugh wrote his friends a letter, advising them that they should “warn the neighbors that we’re loud, obnoxious drunks with prolific pukers among us.” This letter has been reported tonight by the New York Times and the Federalist. So how does this impact things?

Kavanaugh’s letter certainly paints him and his friends as having been outrageous drunks while in college. Taken on its own, no one would care; if we had to start disqualifying people from the upper ranks of government because they drank irresponsibly in college, we might not have too many people left. But this is entirely different when it comes to Kavanaugh, because of the larger context involved.

Brett Kavanaugh’s own words reveal that he lied under oath to the Senate Judiciary Committee about an issue its members considered important. You’re supposed to go to prison for that, not go to the Supreme Court.
